Welcome to the Magnolia Pictures Viral Clip Contest. We are enlisting the help of various film students across the country to assist us in creating online viral marketing components for an upcoming film, THE HOST. This film will be released in the US in February 2007 and has broken almost every conceivable box office record in Korean film history. The teams behind the winning originally produced clips will receive $500 in prize money (for the team as a whole), one VIP Courtesy pass (valid for the pass holder and one guest) to Landmark Theatres (good for one year), and lastly exposure to film executives. As supporters of independent film, we felt it was appropriate to turn to the next generation of talent filmmakers for this innovative project. Each team will choose one clip theme that we encourage you to be creative with. This theme is purposely vague to ensure a variety of responses. Please keep in mind the purpose of these clips as a marketing tool. We want clips that have viral potential, will generate buzz in the online community, look authentic, and follow the guidelines as closely as possible. All clips will be reviewed by a panel of executives at Magnolia Pictures. We will select the best five clips OVERALL to use in our marketing campaign. All material you use for clip development should be original material or material you have the rights to. You will not be given access to the print. You will not see the film. This is required to ensure the originality of submitted ideas. We desire the clips to look real in nature and therefore we do not want it directly tied to the film property. As you read the clip description you will see what the require tasks are.
Clip Description -
PLEASE CHOOSE ONE OF THE TWO FOLLOWING CLIP THEMES
Clip Number 1: SIGHTINGS – television news broadcast type video
GOAL: To create an authentic looking TV news broadcast type video, featuring a story about the sighting of an unusual and unidentified creature near a local body of water.
GUIDELINES / SUGGESTIONS:
• The news story should include on-site video and reporting from the sighting location, as well as a narrated description and report of the incident by the in studio anchor. • Additional footage of on-site reporter interviewing witnesses, local officials, etc. suggested but not required. • The news story may but does not have to include drawings or blurry images of creature, but they should not be too definitive or revealing. • Video should not use any actual news station, network, or news program names, symbols, or footage. All of these should be created specifically for the video. • Music and special FX should be appropriate to the news broadcast format.
Clip Number 5: RESEARCH – semi-documentary style video
GOAL: To create a video showing people being interviewed about mysterious local legends, stories, myths, and so on, in a semi-documentary or public TV style format.
GUIDELINES / SUGGESTIONS:
• Video should include a few “experts” – authors, researchers, scientists, law enforcement officials, etc. – mixed in with the interviews of regular people. • The video should not mention any actual “monster” or urban legend; instead, use words like creature, thing, monster, and it to describe any such being. It can use the names of actual towns and locations if desired. • The video can include a title shot of the name of the fictional documentary if desired, but it is not required.
Timeline
We will need clip submissions by November 17, 2006. Winners will be notified within 7 days. Early submissions are highly encouraged.
Submissions Requirements
Clips should be around 2 minutes in length. Clips over 3 minutes will not be accepted. These clips will be used in the online space, so please keep this the medium in mind when you are developing your material. These clips are for viral purposes, so realism should be your focus.

As a rough guideline it should not be smaller than 320x240 pixels, and not less than 15fps or 750 kbps. Please also remember to keep any text reasonably large and submission length: Max of 3 min. “MAGNOLIA PICTURES VIRAL CLIP CONTEST” OFFICIAL RULES
NO PURCHASE IS NECESSARY TO ENTER OR WIN THIS CONTEST. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
The “MAGNOLIA PICTURES VIRAL CLIP CONTEST” (the “Contest”) starts at 12:00 noon Pacific Time on 10/04/06 and ends at 12:00 noon Pacific Time on 11/17/06. Five (5) Contest winners (the “Contest Winners”) will be determined (as detailed below) at the conclusion of the Contest and notified within seven (7) days thereafter. The sponsor of this Contest is Magnolia Pictures, 49 West 27th Street, 7th Floor, New York, New York 10001 (the “Sponsor”). The Contest shall be subject to these Official Rules, and by entering, all participants agree to be bound by the terms and conditions contained herein.
IMPORTANT NOTICE: ENTRIES THAT DO NOT MEET THE REQUIREMENTS SPECIFIED BELOW WILL BE DISQUALIFIED AND WILL NOT BE JUDGED. ENTRIES MUST BE SUBMITTED ON CD/DVD AS DETAILED BELOW.
BY ENTERING THIS CONTEST, ENTRANTS AGREE THAT ALL ENTRIES AND ANY OTHER MATERIALS SUBMITTED (WHETHER ACCEPTABLE OR NOT, REGARDLESS OF THE FORM THEY TAKE) MAY BE EXHIBITED BY SPONSOR.
“RELEASEES” (AS DEFINED BELOW) TAKE NO RESPONSIBILITY FOR ENTRIES SUBMITTED. ENTRIES WILL NOT BE RETURNED.
ELIGIBILITY: This Contest is open only to legal residents of the contiguous continental United States, eighteen (18) years of age or older as of entry date. A minor will be required to get their parent or legal guardian’s permission prior to participating in this Contest. You may not participate in this Contest if you are under contract with any third party, which might interfere with your ability to enter into agreements with any of the Promotion Parties (as defined herein) or their designees, as determined by the Sponsor, in its sole and absolute discretion. Employees and their immediate family members (specifically defined as a parent, sibling, child or grandparent) of Sponsor, its parent company, and any affiliates, subsidiaries, or advertising, promotion and public relations agencies (collectively, the “Promotion Parties”), and those living in the household of same are not eligible to enter or win. This Contest is void in Alaska, Hawaii, Puerto Rico, all U.S. territories and possessions and overseas military installations and where prohibited or restricted by law.
HOW TO ENTER: Beginning at 12:00 noon (PT) on 10/04/06, you may enter as follows:
1. Complete and sign the Official “MAGNOLIA PICTURES VIRAL CLIP CONTEST” Submission and Release Form (including your name, address, telephone number, date of birth, email address, title of entry, date completed, film credits, and the clip number).
2. Create a clip according to the following specifications and burn it onto a CD or DVD: AVI format must be used. Content should be in a compressed version in good quality in order to be judged. As a rough guideline it should not be smaller than 320x240 pixels, and not less than 15fps or 750 kbps. Please also remember to keep any text reasonably large and submission length: Max of three (3) minutes. No minimum length.
3. Legibly print your name, address, telephone number and e-mail address on the CD or DVD.
4. Mail your completed entry, consisting of the completed Official “MAGNOLIA PICTURES VIRAL CLIP CONTEST” Submission and Release Form and entry CD/DVD to: “MAGNOLIA PICTURES VIRAL CLIP CONTEST”, 2222 S. The Promotion Parties and their respective officers, directors, shareholders, employees and agents, and any and all Internet servers and access provider(s) (collectively, the “Releasees”) are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, servers, providers, or software, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Contest; inability to record an entry to CD or DVD; theft, tampering, destruction, or unauthorized access to, or alteration of entries; data processing that is processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any web site; printing or other errors; late, lost, stolen, mutilated, misdirected, delayed, undelivered, inaccurate, inaudible or postage-due entries or mail or any combination thereof. Proof of submitting an entry is not considered proof of delivery or receipt. Illegible and incomplete entries will be disqualified. All entries become the property of the Sponsor and will not be returned. False and/or deceptive entries or acts shall render entrants ineligible and their entries will be void. By entering the Contest, entrants affirm that they have read and accepted these Official Rules.
SELECTION OF CONTEST WINNERS: All eligible entries received for the Contest will be judged equally according to the following criteria:
The five (5) eligible entries judged to have achieved the highest scores according to the above-specified criteria, as determined by Sponsor in its sole discretion, shall be declared the Contest Winners. Sponsor in its sole discretion shall determine if any entry is inappropriate for publication for any reason. Any such entries deemed to be inappropriate (including, without limitation, due to technical, legal, or other clearance problems) will be disqualified. Sponsor reserves the right to choose fewer than five (5) Contest Winners if, in its sole discretion, it does not receive a sufficient number of eligible and qualified entries.
Contest Winners will be notified within seven (7) days of the end of judging by phone, email, mail or overnight delivery service.
All potential Contest Winners (or potential Contest Winner’s parent or legal guardian if potential Contest Winner is a minor in the jurisdiction in which he/she resides) will be required to execute and return an Affidavit of Eligibility/Release of Liability/Submission Release/Transfer of All Rights and Waiver Agreement form, a completed IRS W-9 form, and a Publicity Release form within five (5) days of date of issuance of notification. Failure to return all required documents within the deadline or comply with these Official Rules may result in the forfeiture of place as a Contest Winner and, at Sponsor’s discretion, a runner-up may be selected. Any notification returned to Sponsor or its fulfillment company as undeliverable for any reason will be forfeited and, at Sponsor’s discretion, a runner-up may be notified.
Sponsor shall have the right to disqualify any entries that it deems to not meet the criteria, or due to technical, legal or other problems, or which it deems to be obscene or otherwise not in good taste, as determined by Sponsor in its sole discretion. Entries may not defame or invade the publicity or privacy rights of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights. Sponsor’s decisions are final and binding with respect to all matters relating to this Contest.
CONTEST PRIZES: Five (5) contest prizes will be awarded and each shall consist solely of the following (the “Contest Prizes”):
(i) a check in the amount of five hundred dollars ($500); and
(ii) one (1) book of guest passes to Landmark Theatres, each book consisting of twenty-five (25) guest passes good for use in calendar year 2007 (subject to the following restrictions: picture ID may be requested upon use, admission limited to available seating, pass is not valid during Special Engagements or when a “no-pass” policy is listed in daily newspaper ads or posted at box office).
The total approximate retail value of each Contest Prize is seven hundred and fifty dollars ($750.00). All details and features of prizes shall be determined by Sponsor in its sole discretion. The total approximate retail value of the prizes to be awarded in this Contest is three thousand seven hundred and fifty dollars ($3,750). Contest Prizes are not transferable or redeemable for cash. No substitution, transfer or cash equivalent of a prize by a winner is permitted except at the sole discretion of the Sponsor. Sponsor reserves the right to substitute a prize (or portion thereof) of comparable value, at its sole discretion. All applicable federal, state, local or other taxes, including but not limited to income and withholding taxes, are the sole responsibility of winners.
By accepting a Contest Prize, entrant irrevocably grants, licenses and assigns to Sponsor or its designee(s), the non-exclusive, perpetual and worldwide right to exploit the winning entry in all media whether now known or hereafter devised, including all advertising, publicity, and promotional rights in connection therewith, and entrant agrees to execute any and all documents necessary to evidence the transfer of such rights.
GENERAL: This Contest is subject to all applicable federal, state and local laws and regulations. All entrants represent and warrant that any material that he or she submits is original, does not infringe upon the copyright or any other right or interest of any other person or organization, and that the entrant has not previously granted any rights to such material to any other person or organization, nor does any third party have any interest in such materials. Sponsor reserves the right to conduct background checks on any prize winner and to verify the accuracy or legitimacy for truthfulness of any information contained within the submitted entry or any required documents described herein. By entering this Contest, entrants represent and warrant (i) that all entries and any other materials submitted (whether acceptable or not, regardless of the form they take) may be exhibited in perpetuity by Sponsor; (ii) that all persons performing in a submitted entry have executed release forms and that entrant holds all rights to all elements of the submitted entry production, including but not limited to performances, music and screenplay; and (iii) that Licensees (as defined below) have the absolute and exclusive right and permission to edit, modify, publish, exploit and use the content of and elements embodied in the entry and the entry itself worldwide in perpetuity in any and all media (whether now known or hereafter devised) and in any manner, for trade, advertising, promotional or any other purposes without further approval, permission or consideration. Entrants also agree that the Promotion Parties, their affiliated and subsidiary companies, licensees, designees and assigns (collectively, “Licensees”) shall have the right and permission to use the name, city and state of residence, signature, voice, picture or other likeness, entry, and/or entry information of entrant in any manner or media now or hereafter known (including, without limitation, placing entrant’s name, entry, and/or entry information onto the Sponsor’s website or any other website or on DVD’s prior to or following motion pictures) without further consideration or notification to or permission from entrant or any third party, except where prohibited by law. Entrants also hereby agree that any use or misuse by any individual of the entrant’s submitted entry shall not be the responsibility of the Releasees.
Releasees shall not be liable for personal injuries, death, damages, expenses or costs or losses of any kind resulting from participation or inability to participate in this Contest or acceptance of or use or inability to use the prize (including any travel or activity related thereto) or parts thereof including, without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Entrants release the Releasees from any and all liability and responsibility with respect to the prizes (including any property loss, damage, personal injury, death or travel related hereto). Winner acknowledges that the aforementioned individuals and entities have neither made nor are in any manner responsible for any warranty, representation or guarantee, expressed or implied, in fact or in law, related to the prizes.
Releasees shall not be liable to winner or any other person for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal) labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Releasees’ sole control.
If for any reason this Contest is not capable of running as planned or does not allow the proper playing of the Contest and processing of entries per these rules, or if tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in Sponsor’s sole opinion, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right, in its sole discretion, to disqualify any individual (and void his/her entry) implicated in such action, and/or to modify or terminate the Contest or further entry in this Contest, as Sponsor deems appropriate. If modification or termination of this Contest occurs, notification will be posted on Sponsor’s website and Sponsor may, at its discretion, select potential prize winners (as detailed above) from among all eligible, non-suspect entries received up to time of action. A potential winner may be requested to provide Sponsor with proof that all eligibility requirements are met. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE COMPETITION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
HOW WILL DISPUTES BE HANDLED?: Each entrant agrees that (i) any and all disputes, claims, and causes of action arising out of or in connection with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of California; (ii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with this Contest, shall be governed by, and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of California or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of California.
