Okay so I was at work all night thining of ways to do this DVD thing. What if we just made the DVD and then some how gave them out. The funding behind the project would need to be figured out but maybe everyone who sends in a movie to the site could get a copy in return for a period of time.

This way...we are not making any money and no one is left in the position of being sued.

...except for the filmmakers, whoever compiles the films, and whoever sends them out to everyone. Profit doesn't matter. Short of getting permission from the artists/organizations, there is no way to legally include copyrighted music on a DVD to send out to people here.

How about this: If you want to be included in the DVD, you gotta remix your films so they have cleared music.

I checked, Slamdance does require everything to be cleared...just like studenfilms.com, they don't check--at any point, they can stop screening it if anyone complains. I guarantee, however, they will check everything going to a distributed free dvd. Profit or money has nothing to do with whether you can use copyrighted music without asking.

Sorry for being negative. I would really like to see this done ...but done legally.

I agree. Just have the First DVD choices chosen.....inform the filmmaker...have them RE-EDIT the film with royalty free music, no music, their OWN composed music, or a NEW soundtrack made FOR them by a COMPOSER. Then they can have it on the DVD...I don't see how it'd be a big deal...plenty of composers are willing to work for FREE....and when distribution is involved..that means THEIR music will be listened to by more people...thus more composers will want to SCORE the CHOSEN films.

I said the same thing about slamdance "If you say its cleared then we won't ask". Sending out a DVD for free does not break any law, its the same thing as showing films on here...I think

Do you want money as a film maker if your film is on the DVD? If so, then you are taking yourself way too serious at this point(which is the biggest problem with YOUNG film makers)...please... get real, there would be about 40 copies made, so why care anyways...its just a nice tool for everyone to have...a collection. Why don't you start asking Chris to give you money for posting "YOUR" films on "HIS" website,lol...god.

I think you've strayed away from the main focus...The question is how can we do this? It's not how can we prove Tyler wrong.

I'll write Chris to see what he thinks...that's the first step

Dude...its STILL illegal to use copyrighted music without owner's permission....whereas most films on this site use copyrighted music, I DOUBT the holders would feel it neccessary for their music removed.

Well what if the holder found out his music was being used in a studentfilm about rape and incest....and it was chosen to be put on a "Best of DVD" Well guess what? They can tell you to ceas and decist this.......that would mean you'd have to take back all the 40 DVDS and then remove the song from that movie, then make new DVDs and all that jazz.

I don't know what I'm talking about. Someone please tell me to shut up.

Good point...but I'm almost sure as Bush is dumb that anything "free" is all good for educational purposes...this is of course what this "DVD" is all about to(lets not forget)...and since we are "students" there would be no reason why we couldn't back up the "DVD" as a educational tool.

Do you all think this is still stealing? No money would be made so nothing would be stolen "money" wise...but I guess you could say you were stealing their ideas "music"...and that could be messed up in some situations, I agree, but I think for this project it is just borrowing and helping a fellow film maker out.

ALSO...anyone who has had a problem with this music thing...do you use KAZAA, have you used NAPSTER? LIMEWIRE? Be honest and if so then stop posting on this topic...that goes for free EDITING SOFTWARE too!

This whole idea that if you aren't making money then it's ok is a myth. We need to think of the music as property. If I steal your property and then give it away instead selling it, does that mean I'm any less guilty of theft? Of course not. It doesn't matter if you sell the dvds or give them away. In either case you're still DISTRIBUTING material without permission. I mean, you can't burn a copy of your favorite CD, and then give copies to all your friends. Even if you don't make any money on it, it's still a violation of copyright. There's been a lot of misunderstanding on this point. COPYRIGHT INFRINGEMENT HAS NOTHING TO DO WITH WHETHER OR NOT YOU MAKE MONEY. Even if you don't get paid, that's still money that the composer is not getting, that he or she is legally entitled to. It has nothing to do with profit/no-profit. People have been willing to look the other way in no-profit situations, but legally they don't have to.
However, I think Kyle had a good idea. Require anyone who wants their film included to have clearance for any and all music (and sound effects!!!) they used therein. People can remix their movies, or they can get a composer.

All of you that are yelling how using copywrited music w/o permission is illegal are correct, we already know that. The important thing is how liable you are to get caught. Like someone said before 70% of this sites films have no permission to use their music, but is it a big deal? No, I don't think theres ever been a case where a company has sued a student for posting their film online (non profit) with their music. So lets discuss what really matters, how likely is it that one would get caught (supposing that we give the copies for free). If we make money from the dvd's, then thats obvious that problems will arrise.

wow kyle that is very ironic. because most of my scripts have incest or rape in them going to copyrighted music.

You know with all this stupid sh*t that the music companys are doing right now with people downloading music and all that good stuff I think it'd be a good idea not to include any copywrited materail or at least not by popular bands, I doubt Duran Duran or UB40 will tear you a new one for using there song. In fact I'm sure the reaction would be more like:

"Pe... Pe... People still listen to us??"
